Verdict in Favor of All Defendants

Basil and Lamya Fattah v. Soli Tran, Mark Grant, Matt Lukens, Ron Lukens and Contractors Roofing and Supply Co., Inc.

RPS Partner who tried case: Seth G. Gausnell

We represented: Soli Tran

Venue: St. Louis City

Facts:  Plaintiffs Basil Fattah and Lamya Fattah alleged to have sustained injuries, loss of consortium and property damage as a result of the collapse of the roof of their apartment, which they rented from defendant/landlord, Soli Tran. As plaintiffs were exiting the apartment, plaintiff Basil Fattah fell down a flight of stairs alleging to have injured his left shoulder, chest, back, left leg and suffering from shortness of breath.

Defendants Mark Grant, Matt Lukens and Ron Lukens, owners and/or employees of The Home Team, were hired by defendant/landlord Soli Tran to replace the roof of the apartment building. The Home Team purchased the roof shingles from defendant Contractors Roofing and Supply Co., Inc. Plaintiffs alleged that Contractors Roofing and Supply Co., Inc. improperly and negligently placed several bundles of shingles on the roof, without first carefully examining the roof, thereby causing the roof to collapse.

Defendants argued that no defects in the roof could be seen and none were known before the roof collapsed. Further defendants argued that plaintiff Basil Fattah’s alleged injuries were pre-existing and not all resulting solely from the incident in question.

After a 4 day jury trial, the jury deliberated for one hour, and returned a verdict in favor of the defendants.
